Denpasar (Antara Bali) – Anand Krishna’s team of lawyers were astounded by the statement of the Coordinator of Team of Defender of Anand Krishna’s Victims (TP-KAK), Agung Mattauch, at the Judicial Commission on Friday December 2nd. Agung Mattauch assessed there were irregularities concerning the acquittal of the team of lawyers’ client.
Dr Otto Hasibuan, SH, MM, one of the lawyers of Anand Krishna, in a press release sent to ANTARA in Denpasar on Saturday reminded that the team of judges who acquitted Anand Krishna was led by a woman who is famous for being honest, clean and dedicated. She is Albertina Ho.
Anand Krishna became the defendant of sexual harassment case and underwent a legal process which lasted for 15 months, has been acquitted by the team of judges at South Jakarta District Court on Tuesday November 22nd.
Otto Hasibuan was confused with the statement of the Coordinator of TP-KAK because it was the prosecutor herself who was not willing to call the expert witnesses.
In fact the team of judges suggested both the prosecutor and his party to call every witness deemed necessary to give his or her testimony again, he said.
"It was indeed the prosecutor Martha P Berliana Tobing who did not want to present the expert witness on psychology Dewi Yogo and the hypnosis expert Mardigu," he asserted.
He added if the two witnesses were presented in the trial, actually their testimonies would help clarify the alleged conspiracy behind the sexual harassment case charged against Anand.
That’s because what has been done by Dewi Yogo to the victim Tara Pradipta Laksmi is considered as an inclination to implant false memory as the result of 45 hypnotherapy sessions within three-four months by Prof Dr LK Suryani (the founder of Committee Anti Sexual Abuse/CASA) and Adi W Gunawan (an expert in hypnotherapy)
“The expert witness Dewi Yogo and Mardigu, in the past in the trial, had given different information about their educational and professional backgrounds. In their curriculum vitae which we received they declared they have ever studied hypnotherapy,” said Otto Hasibuan.
Meanwhile, responding to the questions regarding the irregularities about the sperm evidence that was ignored by the judges, Humphrey R Djemat, Team Coordinator of Anand Krishna’s Lawyers, also admitted to get confused because the evidence never existed.
When investigating the crime scene, he said, Phung Soe Swe alias Chandra, the witness presented by the proseuctor claimed that the toilet and the trash can where he found the tissue containing sperm is located in a public place, not in Anand’s private room.
“Which sperm evidence he meant? In the list of confiscated items in the Police Report, it was never mentioned. Maybe it is only a story or an imagination, not legal evidence. The sperm evidence was not a legal fact,” affirmed Humprey.
Related to the information that the team of judges once sat together with Anand Krishna in the same car when they came to the crime scene and the allegations about hiring a public relation service, Darwin Aritonang, SH, MH, another lawyer of Anand, reminded people to talk about evidence.
“Please talk with evidence, don’t talk with illusion, fiction or talk just to provoke emotions. Please include the legal evidence,” he said.
While Astro P Girsang, SH, a lawyer who defended Anand for almost two years, evaluated the charges against his client were not based on relevant evidence.
“Their accusations are based on gossips and information that cannot be verified. We have documented and recorded all the conversations in the court room so that again we can listen to the revealed facts clearly and unambiguously,” he said.
The acquittal strengthened the alleged attempt to systematically silence Anand and threaten the pluralism in Indonesia, as once expressed by the former Research and Technology minister AS Hikam and the former secretary of state Djohan Effendi.
When the acquittal was read out by Judge Albertina Ho on November 22nd, several pluralism figures and women activists such as Prof. Musdah Mulia, Father Frans Magnis Suseno, and writer Julia Suryakusuma also attended in order to support justice for Anand. (AJ/T007/Translated by Sylvia Antaresa)
